Product Warranty
This product may not be available for purchase or authorized for use in every state. In addition, some states, counties and cities may require special licensing and training to sell, purchase or apply the product. It is the responsibility of the distributor, retailer or professional applicator to verify before product sale/purchase that the product is approved for the use intended in their city, state and county.
NOTICE:
Read the entire Directions for Use and this Warranty Statement before buying or using this product. If the terms are not acceptable, return the product at once, unopened, and reach out to the Company for support.
Warranty Statement:
HGS guarantee shall be limited to the terms set out on the label. The Directions for Use of this product must be followed carefully. The buyer or user assumes the risk to persons or property arising from the use or handling of this product and accepts the product on this condition. HGS warrants that the product conforms to the product description on the label and is reasonably fit for purposes stated on such label only when used in accordance with directions under normal use conditions and when stored as well as handled in a manner that does not adversely affect the product’s performance. It is impossible to eliminate all risks inherently associated with the use of this product such as weather conditions, presence of other materials, storage conditions, or the manner of use or application, all of which are beyond the control of HGS. HGS is not liable for consequential, special or indirect damages resulting from the use of or handling of this product. All such risks shall be assumed by the buyer or user. Except as provided in this Warranty Statement, no other express or implied warranties (including any implied warranty of merchantability or fitness for a particular purpose) are made. No agent or representative of HGS is authorized to make any warranty or representation beyond those contained herein. To the extent consistent with applicable law, or as otherwise agreed between the parties in a separate written agreement, the exclusive remedy of the buyer for any and all claims, losses, injuries or damages resulting from the use or handling of this product shall be the return of the purchase price of this product, or at the election of HGS, the replacement of the product. These conditions shall be interpreted in accordance with the laws of the State of Florida, excluding its conflicts of laws rules.

Il est impossible d’éliminer tous les risques inhérents à l’utilisation de ce produit, notamment ceux liés aux conditions climatiques, à la présence d’autres substances, aux conditions d’entreposage ou aux méthodes d’application, lesquels échappent au contrôle de HGS. En conséquence, HGS ne peut être tenue responsable des dommages indirects, particuliers ou consécutifs résultant de l’utilisation ou de la manipulation du produit. Tous ces risques sont assumés par l’acheteur ou l’utilisateur. Sauf disposition expresse contraire prévue aux présentes, aucune autre garantie, expresse ou implicite (y compris toute garantie implicite de qualité marchande ou d’aptitude à un usage particulier), n’est accordée. Aucun représentant ou mandataire de HGS n’est autorisé à formuler des déclarations ou des garanties autres que celles prévues aux présentes. Dans la mesure permise par les lois applicables, ou sauf convention écrite distincte entre les parties, le recours exclusif de l’acheteur pour toute réclamation, perte, blessure ou dommage résultant de l’utilisation ou de la manipulation du produit se limite au remboursement du prix d’achat ou, au choix de HGS, au remplacement du produit. Les présentes conditions sont régies et interprétées conformément aux lois de l’État de la Floride, à l’exclusion des règles relatives aux conflits de lois.
